Welcome to The Wizard’s Nook.
The terms “we”, “us” and “our” refer to The Wizard’s Nook. The Wizard’s Nook operates this store and website, including all related information, content, features, tools, products and services, in order to provide you, the customer, with a curated shopping experience (the “Services”).
The Wizard’s Nook is powered by Shopify, which enables us to provide the Services to you.
These Terms of Service, together with any policies referenced within them, describe your rights and responsibilities when you use the Services.
Please read these Terms of Service carefully. By visiting, interacting with or using our Services, including by placing an order, you agree to these Terms of Service and our Privacy Policy.
Nothing in these Terms affects your statutory rights under applicable consumer law.

You must be legally capable of entering into a contract to make a purchase through our store.

SECTION 2 – OUR PRODUCTS AND MYSTERY BOOKS
The Wizard’s Nook specialises in curated mystery books, sometimes described as “blind date with a book” products.
Where a product is sold as a mystery book, the title, author, cover artwork and other identifying information about the particular book you will receive are intentionally concealed before purchase. This surprise is an essential characteristic of the product.
We will provide information such as the genre and other characteristics or themes where applicable to help you choose your mystery book. However, unless expressly stated otherwise on the relevant product page, purchasing a mystery book does not guarantee a particular title, author, plot, character, trope, writing style or cover design.
Receiving a particular title, author or story that is not to your personal taste does not by itself mean that the product is faulty or not as described, provided that the book otherwise corresponds with the description under which it was sold.
Nothing in this section limits your statutory rights where goods are faulty, damaged, not of satisfactory quality or not as described.
We make reasonable efforts to represent our products accurately. Colours and appearance may vary slightly depending on your device, display settings, lighting and photography.
Our books may include new or pre-owned books where this is stated or reasonably made clear in the relevant product description. Pre-owned books may show reasonable signs of previous ownership or use consistent with their stated condition.
Product descriptions, availability and ranges may be changed or discontinued from time to time.
SECTION 3 – ORDERS
When you place an order, you are making an offer to purchase the products in your basket.
An order is not accepted until we have accepted the order and payment has been successfully processed. You will receive confirmation using the contact information supplied during checkout.
We reserve the right to decline or cancel an order where reasonably necessary, including where a product is unavailable, there has been an obvious pricing or listing error, payment cannot be authorised, fraud or misuse is suspected, or we cannot fulfil the order.
If we cancel an order after payment has been taken, any amount due to you will be refunded using the original payment method unless otherwise agreed.
Please check your order and delivery details carefully before submitting your purchase.
Cancellation and return rights are set out in our Refund Policy and are subject to your statutory rights.
SECTION 4 – PRICES AND PAYMENT
Prices are displayed in the currency shown on the store and may change from time to time.
The price applicable to your purchase will normally be the price displayed when you place your order, subject to the correction of obvious errors.
Delivery charges, where applicable, will be shown during checkout before you complete your purchase.
For international orders, customers may be responsible for customs duties, import taxes or other charges imposed by the destination country unless we expressly state otherwise. These charges are outside our control.
You agree to provide accurate and complete payment and billing information and confirm that you are authorised to use the payment method supplied.
Promotions, discounts or promotional codes may be subject to separate conditions. Where separate promotional conditions conflict with these Terms in relation to that promotion, the promotional conditions will apply.
SECTION 5 – SHIPPING AND DELIVERY
We aim to dispatch orders within the times stated on our website. Estimated delivery times are estimates and may be affected by postal carriers, customs processing, severe weather, industrial action or other circumstances outside our reasonable control.
We are not responsible for delays caused by circumstances outside our reasonable control, but this does not affect any rights you may have under applicable consumer law.
For consumer orders, responsibility for the goods remains with us until the goods come into the physical possession of you, or a person identified by you to receive them, except where applicable law provides otherwise.
Customers are responsible for providing a complete and accurate delivery address. If an order cannot be delivered because incorrect or incomplete information was supplied by the customer, additional postage charges may apply where the order needs to be resent.

Unless otherwise stated, the original content created for The Wizard’s Nook website, including our branding, original text, graphics, photographs, designs, logos and other original materials, belongs to The Wizard’s Nook or is used with permission from the relevant rights holder.
Third-party book titles, book cover artwork, author names, publisher names, trademarks and other intellectual property remain the property of their respective owners. Their appearance on our store does not imply ownership by or affiliation with The Wizard’s Nook unless expressly stated.
You may use the Services for personal, non-commercial purposes. You must not reproduce, republish, distribute, sell or commercially exploit our original website content without prior permission, except where permitted by law.
Shopify’s names, logos, products and services are the property of Shopify or its licensors.

SECTION 9 – RELATIONSHIP WITH SHOPIFY
The Wizard’s Nook is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with The Wizard’s Nook.
By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and The Wizard’s Nook, including any injury, damage, or loss resulting from purchased products and services.
You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with The Wizard’s Nook, to the extent permitted by applicable law.

If you are purchasing as a consumer, we do not exclude liability for losses arising from our breach of your statutory rights.
